Terms & conditions

Art. 1

Scope of applications and modification of terms and conditions

Following terms and conditions (below “Terms”) apply to relations between Grenadino Sàrl (below Webfoodies.ch/hotsauce) and to all customers who place an order online on www.hotsauce.ch (below “customer” or “customers”).

Hotsauce.ch reserve the right to amend at any time the terms, which will then take effect immediately upon all new order following the amendment thereof.

For each order, the client must review and agree with general terms and conditions. The latter apply to all orders placed by the client (below “order”). Any specific conditions mentioned on “hotsauce.ch” (below “web site”) relating to displayed products are an integral part of the terms and conditions. In case of discrepencies between specific conditions and general terms, specific conditions do prevail.

Art. 2

Products mentioned online and customers’ orders

Products as displayed in their real time condition on the website are solely advisory and do not refer to offers by hotsauce.ch in particular. Pictures displayed on the website are not binding.

Any information provided on www.webfoodies.ch (product description, pictures, films, dimensions, weight, technical specifications, accessories and other data) are solely advisory and do not consist of any formal warranty of said information. Hotsauce.ch decline any responsibility regarding the content of external web pages.

Based on such non-binding information, the client may order a displayed product, provided procedures and methods directed by the web site are respected.

All orders placed by the client according to the website regulations constitute the client’s offer to buy the displayed product under the terms and conditions.

For each order, the client must indicate a valid email address to which Hotsauce.ch can send all information relating the order.

Email address validity and knowledge of the messages sent by hotsauce.ch is the client’s responsibility only. Any email sent by hotsauce.ch to said address will be regarded as read and acknowledged from the first day following sending. Risks regarding transmission and conveyance of messages are the client’s responsibility only.

The client may notice hotsauce.ch of any change in shipping destination up to 72 hours following the order confirmation. Such change will nonetheless be taken into consideration only if the order hasn’t yet been shipped to the client. Failure to respect the time restrictions mentioned above will result in the client’s responsibility to recover the order at the initial shipping location.

Art. 3

Order validation – Firm and non-cancellable orders

To place an order, the Client must be of age (18 years of age) and no be under any form of trusteeship. It is the Client’s responsibility to make sure all communicated information is correct. The client must answer for any impairment caused to hotsauce.ch should false information be mentioned.

Any order placed by the client in accordance with art. 2 constitutes a firm and definitive offer to buy the item displayed as available on the website. Once finalized by the Client, said order cannot be withdrawn until a decision of acceptance or refusal has been reached by hotsauce.ch.

Hotsauce.ch reserves the right to accept or refuse any order without giving any motives for the decision made. Hotsauce.ch will communicate its acceptance by email to the address indicated in the order by the Client (order confirmation).

Art. 4

Prices

Hotsauce.ch reserves the right to modify its prices at any moment, but commits to charge the client according to the price displayed at the time of the order placement.

Prices are in Swiss francs and include all taxes (recycling SWICO, VAT). Delivery costs, which are indicated on the order form, will be at the client’s expanse.

Prices shown on the website are only valid within the Swiss territory and the principality of Liechtenstein.

Art. 5

Down payments and securing

The Client’s offer to order an item on Hotsauce.ch involves a payment in advance of the total sum as well as any debit card extra charges (Visa, Mastercard and Postcard debit direct only).

Down payment are transferred to secured hotsauce.ch partner banking servers, as offered on the website. This implies no banking information concerning the Client may pass via Hotsauce.ch websties. Payment by credit or debit card is therefore completely secure.

That order will be registered and validated as soon as the Client’s payment order has been accepted. The order will be accepted and the Client’s debit or credit card will be charged automatically order registration.

The Client must imperatively fill the sign-up form displayed on the website before being able to validate any order. Credit card details are crypted according to SSL protocols (Secure Socket Layer) and never pass through on the network in the clear. Down payment are directly transferred to the bank or postal bank. Card number is not communicated to hotsauce.ch. Any risk regarding payment methods is borne by the client.

Art. 6 

Shipping methods and periods.

Items are delivered to the shipping address indicated in the Client’s order. Risks regarding

Merchandise shipping to the Client (risk of loss, damage, wrong delivery address, etc.) are borne by the client as soon as merchandise has been handed by Hotsauce.ch to the delivery company assigned for the task by Hotsauce.ch. In case of mistakes in the wording of the shipping address, hotsauce.ch declines all responsibility regarding delivery impairment.

Any costs relating the return of an unclaimed package and possible reshipping are at the Client’s expanse. Before all reshipping, Hotsauce.ch reserves the right to charge the Client with relating costs.

In the case of an unclaimed package, Hotsauce.ch declines all responsibility, including instances where postal services do not provide delivery notice to the Client. Return costs as well as related risks are the client’s responsibility.

In case of package return to Hotsauce.ch premises following a failure to deliver (Wrong shipping address, postal turnaround exceeded, etc…), the client is automatically noticed of the impairment by email at the address provided in the order. Without any further update from the Client within a period of 1 month starting the day of the email sending, Hotsauce.ch reserves the right to cancel the order. In such case, Hotsauce.ch is relieved of its obligations to deliver the package and the down payment for the order will kept by Hotsauce.ch, as conventional compensation, applying to all accounts regarding the order.

Delivery is handed by either postal services or a forwarding agent assigned by Hotsauce.ch.

Any item in stock and available is to be shipped within the 10 following business days (week-ends and holiday excluded). Shipping periods indicated on the website are based on an average and include processing, preparation and shipping (warehouse exit).

If Hotsauce were in the incapacity to deliver the order within 20 days after shipping (warehouse exit date), the Client may cancel the order by email or by mail including order details to Hotsauce.ch customer service.Order cancellation will only take effect provided it has effectively been communicated to Hotsauce.ch 24h prior final delivery by the assigned forwarding agent. If not, the order cancellation will not be validated. Cancellation must also be communicated to Hotsauce.ch prior 40 days after the order placement.

In case of valid cancellation, all down payments regarding the order will be fully refunded to the Client. The Client will not be able in any way to claim additional damages from Hotsauce.ch, as the Client’s expectations are limited to the down payment full refund.

Hotsauce.ch also reserves the right to cancel any order without justifying its motives to the Client. In such case, the Client’s expectations from Hotsauce.ch are limited to the down payment full refund, excluding any further damages.

Art. 7

Responsabilities

Hotsauce.ch declines all responsibility should any marketed product be misused or improperly consumed. Our marketed products are not recommended for people under age 18 and people with sensitivity to chili pepper. Hot sauce must be consumed sensibly.

Art. 8

Data protection

By signing up on the Hotsauce.ch website, the Client expressly accepts to receive promotional offers and other information from Hotsauce.ch. The Client may unsubscribe at any time, easily and free of charge, by following instructions in each message received from hotsauce.ch, or by contacting Hotsauce.ch customer service.

Hotsauce.ch may reveal personal data to a third party only if it becomes necessary for the successful processing of the order.

Hotsauce.ch reserves the right to analyze all collected data and use information relating purchasing habits anonymously for commercial purposes. Hotsauce.ch reserves the right at all time to blacklist a subscribed Client from its database, and cancel his or her subscription, with immediate effect, without having to justify its decision or warning the Client and this without leaving said Client the possibility to claim any expectations from the company. This applies especially for subscribers that may break the current terms of agreements.

Blacklisted subscribers may not be authorized to submit any further subscription to Hotsauce.ch websites, should it be under their real name or another identity, without prior authorization from Hotsauce.ch.

Applicable rights and jurisdiction

The present contract, as well as all sales conducted by Hotsauce.ch, is ruled by Swiss law. In case of litigation, Lausanne shall remain exclusive jurisdiction as any appeal will remain reserved.

Hotsauce.ch terms and conditions are written in French and English. In case of contradiction, the French version is admissible.
